Justice MS Karnik had granted bail to the 73-year-old Nationalist Congress Party leader on December 12, but stayed the order for 10 days as the CBI sought time to challenge it in the Supreme Court.
A three-judge bench headed by Justice A M Khanwilkar said Desmukh is at liberty to access remedies available to him under the law.
The 73-year-old leader was greeted by senior leaders of his party as he walked out of Mumbai's Arthur Road prison around 4.45 pm.

The Bombay High Court on Tuesday said its division bench (comprising two judges), instead of a single-judge bench, would hear the petition filed by Maharashtra's former home minister Anil Deshmukh against the summons issued to him by the Enforcement Directorate in a money laundering case.
He said the "switch" to the Sharad Pawar-led outfit has started in the form of ex-corporators, referring to the resignation of Ajit Pawar-led NCP's Pimpri-Chinchwad unit chief Ajit Gavhane and two former corporators.
The FIR was registered against Deshmukh and some unidentified persons on April 24 this year on charges of corruption and misconduct following a preliminary inquiry that the CBI conducted in compliance with the high court's order.
The agency also alleged that Deshmukh exercised undue influence to pass favourable transfers and postings of the police officials.
"It is complete red herring. I thought the state will see some sense. But, these are different nature of battles. Sorry, dismissed," the bench said.
"Looking at the personas involved and nature of allegations and seriousness of allegations, it requires investigation by an independent agency, the SC said.
The Sessions Court judge presiding over the trial was appointed to this court just a few months ago. Annoyed at its slow pace, he is cracking the whip on the prosecution.
The Supreme Court on Thursday junked a plea filed by former Maharashtra home minister Anil Deshmukh seeking records, including file notings and internal correspondence, of the preliminary enquiry report in the corruption case, saying "should we entertain this because he has been a minister."

Singh had initially approached the Supreme Court, alleging he was transferred from the post of Commissioner Police of Mumbai on March 17 and shunted to the Home Guards department after he complained to Maharashtra Chief Minister Uddhav Thackeray and other senior leaders about the "corrupt malpractices" of Deshmukh.
